Information Collected by IDX24
Usage Data: As described in this section, we automatically collect certain information when you use the IDX24 Network (“Usage Data”). Usage Data includes the information that your web browser automatically sends to our servers whenever you visit. The Usage Data collected in our server logs may include information such as your web request, Internet Protocol address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser. We send the cookies to your browser when you visit the IDX24 Sites. We use both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the IDX24 Sites. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the IDX24 Network may not function properly if the ability to accept cookies is disabled. In addition, the IDX24 Network may employ "clear GIFs" (a.k.a. web beacons) which are used to collect further Usage Data regarding the online usage patterns of our users. We may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by recipients. We may combine Usage Data with Personal Data in a manner that enables us to trace Usage Data to an individual user.
The Way IDX24 Uses Information
We may use your Personal Data and Usage Data (together, “User Information”) to operate, maintain, and provide to you the features and functionality of the IDX24 Network.
We do not use your email address or other Personally Identifiable Information to send you commercial or marketing messages without your consent. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major IDX24 Site changes or for customer service purposes).
We use your User Information to (a) improve the quality and design of the IDX24 Network and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends; (b) remember information so that you will not have to re-enter it during your visit or the next time you visit the IDX24 Network; (c) provide custom, personalized content, information and advertisements; (d) monitor the effectiveness of our marketing campaigns; (e) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (f) track your uploads, entries, submissions and similar uses of the IDX24 Network.
Information That IDX24 May Disclose
There may be areas of the IDX24 Network that (e.g., public pages, chat rooms, bulletin boards, and other online forums) in which you are able to submit User Submissions that will be available to all or some other users, including casting professionals, their affiliates and clients, of the IDX24 Network. By choosing to use these areas, you understand and agree that anyone may access, use, and disclose any User Submissions, including any information, any pictures, text or video, that are included. Such User Submissions and information may be redistributed throughout the Internet and offline. Please do not include, in your User Submissions, any Personal Data or images of: (i) any third party unless such third party has consented to such use, or (ii) any children under the age of 13.
If you authorize us to do so, by using applicable sections of the IDX24 Network, from time to time we may share your User Information, including Personally Identifiable Information, with third parties, including casting professionals, their affiliates and clients, so they may contact you regarding opportunities, services or goods in which you may be interested. We are not responsible for the content or privacy and security practices and policies of such third parties. If you have authorized us to do, and later decide that you would no longer like us to further disclose your Personally Identifiable Information to third parties for such purposes, please contact us as noted below in Section 4.A.
We share Non-Personally Identifiable Information and Usage Data (such as anonymous user usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the IDX24 Network.
Our Commitment To Data Security
IDX24 uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. Such safeguards include requesting a unique password to verify your identity before granting access to your account profile page. We cannot, however, ensure or warrant the security of any information you transmit to IDX24 and you do so at your own risk. You are responsible for maintaining the secrecy of your unique password and account information at all times. Once we receive your transmission of information, IDX24 makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If IDX24 learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. IDX24 may post a notice on the IDX24 Network if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should notify us by contacting us as described in Section 12 below.
Our Commitment To Children's Privacy
We are committed to protecting the privacy needs of children. For that reason, IDX24 does not knowingly collect or maintain Personal Data on or through the IDX24 Network from persons under 13 years of age, and no part of the IDX24 Network is directed to persons under 13. If you are under 13 years of age, then please do not use or access the IDX24 Network at any time or in any manner. If we learn that Personal Data of persons under 13 years of age has been collected on the IDX24 Network, then we will take the appropriate steps to delete this information from our systems. If you are a parent or guardian and discover that your child under 13 years of age has provided Personal Data to us, then you may alert us at [firstname.lastname@example.org] and request that we delete your child’s Personal Data from our systems.
Special Note to International Users
Third Party Services
The IDX24 Network contains links to web sites and services provided by third parties, and, at your direction may connect to third party web sites through the use of an application program interface (API). Any information you provide on third party sites or services or by connecting through an API is provided directly to that third party and is subject to that third party’s policies, if any, governing privacy and security. We are not responsible for the content or privacy and security practices and policies of such third party sites or services. We encourage you to learn about third parties’ privacy and security policies before providing them with information.
In the Event of Merger, Sale, or Bankruptcy
In the event that we are acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, assignment, assumption, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your User Information is treated, transferred, or used.
